These Terms and Conditions ("Terms") are entered into between you and Travis Mitchell ("BioTracker," "we," "us") and govern your use of the BioTracker iOS application and the website at downloadbiotracker.com (together, the "Service").
By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
BioTracker is an organizational and informational tool that helps you plan supplement, peptide, and compound stacks, schedule doses, receive reminders, and track adherence. BioTracker is not medical advice, is not a medical device, and is not a substitute for consultation with a qualified healthcare professional. Nothing in the Service constitutes a diagnosis, treatment, prescription, or endorsement of any specific compound, dose, or protocol.
You are solely responsible for how you use information generated by the Service and for any decisions you make about substances you consume or administer.
2. Eligibility
You must be at least the age of majority in your jurisdiction to use the Service. By using the Service, you represent that you meet this requirement.
3. Accounts
Some features require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.
4. Subscriptions and purchases
BioTracker offers auto-renewing subscriptions to unlock premium features. The intended subscription products are:
- BioTracker Pro Weekly — $1.99 per week
- BioTracker Pro Annual — $39.99 per year
Each is intended to include a seven-day introductory trial for eligible users. Final pricing, trial eligibility, currency, and availability are determined by the live Apple purchase sheet at the time of purchase and may vary by region.
All purchases are processed by Apple through the App Store and are subject to Apple's billing terms. Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through your Apple ID subscription settings at apps.apple.com/account/subscriptions.
You can restore previous purchases using the "Restore Purchases" option inside BioTracker. Refund requests must be directed to Apple through their standard refund process. We do not process refunds and do not promise refunds.
5. Apple Standard EULA
The BioTracker iOS application is licensed, not sold, to you and is provided under the terms of the Apple Standard End User License Agreement (the "Apple EULA"), which is incorporated into these Terms by reference. In the event of a conflict between these Terms and the Apple EULA with respect to the licensed iOS application, the Apple EULA governs.
You acknowledge that Apple has no obligation whatsoever to provide any maintenance or support services with respect to the app, and that Apple is a third-party beneficiary of these Terms with respect to the licensed application, with the right to enforce them against you.
6. Acceptable use
You agree not to:
- Use the Service in violation of applicable laws or regulations
- Attempt to reverse-engineer, decompile, or bypass technical protections
- Interfere with the operation, security, or integrity of the Service
- Use the Service to provide medical advice or diagnosis to others
- Upload content that is unlawful, infringing, or harmful
7. User content
You retain ownership of the information you enter into BioTracker. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display the content only as necessary to provide, secure, support, and maintain the Service. This license does not permit us to use your content to train machine-learning or generative-AI models, to serve advertising, or to broadly improve unrelated products or services.
8. Intellectual property
BioTracker, including its software, design, and branding, is owned by us or our licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
BIOTRACKER DOES NOT PROVIDE MEDICAL, HEALTHCARE, OR PROFESSIONAL ADVICE. YOU ASSUME ALL RISK ASSOCIATED WITH DECISIONS YOU MAKE BASED ON INFORMATION IN THE SERVICE.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BIOTRACKER OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$50.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service.
12. Governing law
These Terms are governed by the laws of California, United States, without regard to conflict-of-law principles.
13. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by other appropriate means. Continued use of the Service after changes take effect constitutes acceptance.
